Shopify hosts our store and processes personal information to provide and support the Services, including checkout, payments, and store operations.
Information submitted through the Services may be transmitted to Shopify and its service providers in countries other than your country of residence.
For certain processing activities, Shopify acts independently and is responsible for responding to requests relating to that processing. This does not remove our responsibility for personal information that we control.
For more information about Shopify’s practices, please review the Shopify Consumer Privacy Policy. You may also exercise applicable rights through the Shopify Privacy Portal.
8. Retention of Personal Information
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, unless a longer period is required or permitted by law.

10. California Privacy Notice
This section provides additional information for California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”). These rights apply to the extent that we and the relevant processing are subject to the CCPA.
Information Handling During the Previous 12 Months
[Before publication, insert a verified summary of the categories of personal information actually collected during the preceding 12 months, the categories disclosed for a business purpose and their recipient categories, and any categories sold or shared and their recipient categories. If no sale or sharing occurred, state that expressly after confirming the practices of Shopify features and other integrations.]
The sources of personal information and our purposes for using it are described in Sections 3 and 4. Our retention criteria are described in Section 8.
Your California Rights
Subject to applicable conditions and exceptions, you may have the right to:
- Know and access: Request the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting, selling, or sharing information, and the categories of third parties to whom information is disclosed.

Sensitive Personal Information
[Before publication, confirm the categories of sensitive personal information processed and their purposes. If its use and disclosure are limited to legally permitted purposes that do not trigger a right to limit, state that accurately. Otherwise, describe the additional uses and provide the required limitation mechanism.]
How to Submit a Request
To request access, deletion, correction, or an applicable limitation of sensitive information use, email kimonocafe@e-wazakka.com.
[Before publication, add any additional request method required by the CCPA. Confirm whether the exception allowing an email-only method for qualifying exclusively online businesses applies.]
You can submit a request to opt out of sale or sharing through our Do Not Sell or Share My Personal Information page or by emailing kimonocafe@e-wazakka.com.
We may verify your identity when processing requests to access, delete, or correct information by matching information you provide with our existing records. We request only information reasonably necessary to verify and process your request.
You do not need to create an account to submit a request. Requests to opt out of sale or sharing do not require identity verification, although we may need sufficient information to apply your choice.
An authorized agent may submit a request on your behalf. Where permitted by law, we may request proof of authorization and confirmation of your identity or the agent’s authority.
We will respond within the time required by applicable law and explain any permitted denial or extension.
Global Privacy Control
Where required by applicable law, we honor qualifying opt-out preference signals, including Global Privacy Control (“GPC”), as requests to opt out of sale or sharing.
The choice applies to the browser or device sending the signal and to associated profiles or accounts where we can identify them as required by law. You may need to enable the signal separately on other browsers or devices.
More information is available at globalprivacycontrol.org.
Browser “Do Not Track” settings are distinct from GPC. We do not respond to those settings unless required by applicable law.
11. Residents of Other U.S. States

To exercise applicable rights, contact kimonocafe@e-wazakka.com or use the relevant privacy controls on our website.
If we decline a request, you may appeal where applicable by emailing the same address with the subject line “Privacy Request Appeal.” We will review and respond within the applicable legal deadline. Where required, our response will explain how to contact the relevant state authority if your appeal is denied.
We will not unlawfully discriminate against you for exercising your privacy rights.
12. Children’s Privacy
The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13.
If you believe a child under 13 has provided personal information to us, please contact us so that we can investigate and take appropriate action.
We do not knowingly sell or share personal information of individuals under 16.
13. International Processing
We are based in Japan. Personal information is processed in Japan and may also be processed in the United States and other countries where Shopify and our service providers operate.
Privacy laws in these countries may differ from those in your place of residence. We apply safeguards required by applicable law to relevant international transfers.
14. Third-Party Websites
The Services may contain links to third-party websites or services. Their privacy practices are governed by their own policies. Please review those policies before providing personal information.
15. Changes to This Privacy Policy

TERMS OF SERVICE
OVERVIEW
Welcome to kimonocafe. This store is operated by Ando Co., Ltd., a company based in Kyoto, Japan, trading as kimonocafe. Throughout these Terms of Service, “we,” “us,” and “our” refer to Ando Co., Ltd., operating as kimonocafe.
We operate this website and its related content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify.
These Terms of Service (“Terms”), together with the policies expressly incorporated by reference, govern your use of the Services and purchases from our store.
Please read these Terms carefully. By using the Services or placing an order, you agree to these Terms. Our Privacy Policy separately explains how we handle personal information.
Nothing in these Terms excludes or restricts any consumer rights or remedies that cannot lawfully be excluded or restricted.
SECTION 1 — ACCESS AND ACCOUNTS
To place an order, you must be of legal age to enter into a binding contract in your place of residence, or act through a parent or legal guardian who places the order on your behalf.
You agree to provide accurate, complete, and current information, including your contact, billing, payment, and shipping details. You must be authorized to use the payment method provided.
If you create an account, you are responsible for keeping your login credentials confidential and for promptly notifying us of suspected unauthorized use. You may not sell or transfer your account to another person without our permission.
SECTION 2 — OUR PRODUCTS
kimonocafe offers kimono accessories and other items incorporating Japanese design and craftsmanship.
We make reasonable efforts to describe and display our products accurately. Colors may appear differently depending on your device and display settings.
For products identified as handmade or made using traditional techniques, slight variations in dimensions, pattern placement, texture, or color may occur. Such variations do not excuse a material difference from the product description or affect your rights regarding defective or incorrectly supplied products.
Please review each product’s description, measurements, materials, and care instructions before ordering. Accessories shown in photographs are included only where the product description expressly states that they are.
We may update listings, discontinue products, or limit quantities. Changes to a listing do not retrospectively change the description or agreed terms of an accepted order.
SECTION 3 — ORDERS AND ACCEPTANCE
Placing an order constitutes an offer to purchase the selected products under these Terms.
An automated order acknowledgment confirms receipt of your order. Your order is accepted when we send a shipping confirmation or otherwise expressly confirm acceptance.
We may decline or cancel an order for a legitimate reason, including product unavailability, unsuccessful payment, a material pricing error, suspected fraud, or an unsupported delivery address.
If we cancel an order after collecting payment, we will promptly refund the amount paid for the canceled items and any associated charges that are refundable under applicable law. We will not substitute products or increase the agreed price without your consent.
Please check your order carefully before submitting it. If you need to request a change or cancellation, contact us promptly at kimonocafe@e-wazakka.com. We may be unable to change an order once preparation or shipment has progressed, subject to your legal rights and our posted policies.
SECTION 4 — PRICES AND PAYMENT
The applicable price and currency are those displayed at checkout when you place your order.
Shipping charges and any taxes or import charges collected by us will be displayed before you complete your purchase. Charges not collected at checkout may be payable separately where applicable, as explained in the delivery information presented before purchase.
Your bank or payment provider may apply currency conversion or international transaction fees. Those fees are determined by that provider.
Prices and promotions may change, but changes do not affect accepted orders. Any separate promotion terms will apply to that promotion, subject to applicable law.
You agree to provide accurate payment information and authorize the applicable payment provider to process the amount shown at checkout.
SECTION 5 — SHIPPING AND DELIVERY
This store is intended to serve customers in the United States. Available delivery destinations and options are those offered at checkout.
Please provide a complete and accurate delivery address. Contact us promptly if you discover an error.
Shipping and delivery estimates are provided in the product listing, checkout, order communications, or shipping information available on our website. Delivery may be affected by carrier operations, customs processing, or circumstances beyond our reasonable control.
If we cannot ship within the stated timeframe, we will notify you and provide any opportunity to consent to a revised timeframe or cancel for a refund required by applicable law.
If a shipment is lost, damaged, or significantly delayed, contact us at kimonocafe@e-wazakka.com so that we can investigate and arrange an appropriate resolution. Handing a parcel to a carrier does not, by itself, eliminate our obligations to you.
Any customs duties, import taxes, or clearance charges will be handled according to the information disclosed before purchase and applicable law. We do not guarantee that an order will qualify for a particular customs exemption.
SECTION 6 — RETURNS, REFUNDS, AND EXCHANGES
Our Return and Refund Policy, available on our website and through the policy links at checkout, explains the applicable conditions and procedures for returns, refunds, and exchanges.
The version presented at the time of your purchase applies to that purchase. Nothing in that policy or these Terms limits any mandatory rights you have regarding defective, damaged, incorrectly supplied, or undelivered products.
For assistance, contact kimonocafe@e-wazakka.com.
SECTION 7 — INTELLECTUAL PROPERTY
The website’s original text, photographs, graphics, logos, design, and other content are owned by Ando Co., Ltd. or used with permission from the relevant rights holders.
You may browse the Services and save or print information reasonably necessary for personal shopping, order records, or exercising your legal rights.
Except as permitted by law or with the relevant owner’s permission, you may not reproduce, distribute, commercially exploit, or create derivative works from protected content.
The kimonocafe name and logo, Shopify’s names and logos, and other third-party marks remain the property of their respective owners.
Customer reviews and other submissions are governed by Section 11.
SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY LINKS
The Services may provide access to third-party tools, websites, or services. Those providers may have their own terms and privacy policies, which you should review before using their services.
We do not control independently operated third-party websites and do not endorse their content solely by linking to them.
To the extent permitted by law, we are not responsible for independently supplied third-party services. This does not exclude our responsibility for fulfilling your order or performing obligations that we owe to you.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
kimonocafe is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with kimonocafe. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and kimonocafe, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with kimonocafe.
This section applies only to the extent permitted by applicable law and does not waive rights that cannot lawfully be waived.
SECTION 10 — PRIVACY
Our Privacy Policy, available through the privacy policy links on our website and at checkout, explains how we collect, use, disclose, and retain personal information.
Because Shopify hosts the Services, Shopify also processes personal information in connection with website operation, checkout, and related functions. Certain processing is governed by Shopify’s own privacy policy, available at https://www.shopify.com/legal/privacy/consumers.
Personal information may be processed in Japan, the United States, and other countries where relevant service providers operate, as explained in the applicable privacy policies.
Acceptance of these Terms does not replace any separate consent required by privacy law.
SECTION 11 — REVIEWS AND OTHER SUBMISSIONS
If you submit a review, photograph, suggestion, or other content for publication through the Services (“Feedback”), you retain ownership of that content.
You grant us a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, and format that Feedback for operating and presenting our store and its products. We may allow service providers to process it for those purposes.
This license does not transfer ownership of your Feedback and does not apply to private customer support communications merely because you send them to us.
You must have the rights needed to submit the Feedback. It must not contain unlawful material, malicious code, another person’s confidential information, or content that infringes another person’s rights. Any incentive or material connection relevant to a review must be disclosed where required by law.
We may remove spam, fraudulent submissions, unlawful content, and other content that violates reasonable, consistently applied moderation rules. We will not remove a review solely because it is negative, or alter it to misrepresent the reviewer’s opinion.
Nothing in these Terms prevents you from posting an honest review or imposes a penalty for doing so.
SECTION 12 — ERRORS AND CORRECTIONS
We may correct typographical errors or inaccuracies in product descriptions, prices, availability, and other website information.
If an error materially affects your order, we will contact you to explain the issue and, where appropriate, offer you the choice of proceeding on corrected terms or canceling for a refund.
We will not automatically charge you a higher price than you authorized. Corrections remain subject to applicable law and your rights under an accepted order.
SECTION 13 — PROHIBITED USES
You may use the Services only for lawful purposes. You must not:
- Commit fraud or provide information you know is materially false.
- Infringe intellectual property, privacy, or other legal rights.
- Threaten or unlawfully harass other users or our staff.
- Upload malicious code or interfere with the operation or security of the Services.
- Access accounts or systems without authorization.
- Collect other users’ personal information without a lawful basis.
- Send spam or impersonate another person.
- Use automated tools to bypass access restrictions, manipulate orders, or place an unreasonable load on the Services.
- Reproduce or commercially exploit protected website content without authorization.
These restrictions do not prohibit honest reviews, lawful complaints, accessibility tools, or activities protected by applicable law.
SECTION 14 — AUTOMATED TOOLS AND AGENTS
If you authorize an automated tool or agent to interact with the Services on your behalf, you remain responsible for the instructions and purchasing authority you provide to it.
Automated tools must not conceal their identity when reasonably requested, bypass security or access controls, or act beyond the user’s authorization.
We may restrict automated access that threatens security, disrupts the Services, or violates these Terms.
This section does not prohibit ordinary assistive technologies used for accessibility.
SECTION 15 — SUSPENSION AND TERMINATION
We may suspend or restrict access where reasonably necessary to address fraud, unlawful conduct, security risks, or a material breach of these Terms.
Where appropriate and legally required, we will provide notice and an opportunity to resolve the issue.
Termination of access does not remove obligations relating to accepted orders, refunds, outstanding payments, or rights that arose before termination.
Provisions that by their nature should continue, including intellectual property, applicable liability provisions, governing law, and dispute provisions, survive termination.
SECTION 16 — WARRANTIES
We aim to provide reliable Services and products that conform to their descriptions.
To the extent permitted by law, website functions and optional online tools are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free website access.
Nothing in these Terms excludes an express promise we make about a product or any warranty, guarantee, or remedy that cannot legally be excluded.
Any limitation of warranties applies only to the extent permitted by the law applicable to your purchase.
SECTION 17 — LIMITATION OF LIABILITY
To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of the Services, including business-related lost profits or lost business opportunities.
This limitation does not exclude or restrict liability for fraud, willful misconduct, gross negligence, death or personal injury where liability cannot lawfully be limited, or any other liability that applicable law does not permit us to exclude or limit.
Nothing in this section removes your right to an applicable refund, replacement, or other mandatory remedy.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitations apply only to the extent permitted by law.
SECTION 18 — RESPONSIBILITY FOR UNLAWFUL CONDUCT
To the extent permitted by law, you are responsible for losses we reasonably incur as a direct result of your fraudulent or unlawful use of the Services or your intentional infringement of a third party’s rights.
This section does not require you to compensate us for losses caused by our own misconduct or impose liability merely because you browse the website, purchase a product, or submit an honest review.
SECTION 19 — SEVERABILITY
If a provision of these Terms is found unlawful or unenforceable, it will apply only to the extent legally permitted or, where necessary, be treated as severed.
The remaining provisions will continue in effect to the extent permitted by law.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
These Terms, together with the applicable purchase details and policies incorporated by reference, form the agreement between you and us concerning the Services and your purchase.
Nothing in this section excludes legally binding representations or rights that cannot lawfully be excluded.
SECTION 21 — ASSIGNMENT
You may not transfer your contractual obligations under these Terms without our consent, except where applicable law allows.
We may transfer our rights and obligations as part of a lawful business transfer, provided that the transfer does not reduce your mandatory consumer rights. We will provide notice where required by law.
SECTION 22 — GOVERNING LAW AND DISPUTES
These Terms and transactions with kimonocafe are governed by the laws of Japan, subject to any mandatory consumer protections that apply in your place of residence and cannot be excluded by agreement.
Please first contact kimonocafe@e-wazakka.com if you have a concern so that we can attempt to resolve it.
Subject to applicable law, the courts of Kyoto, Japan, have non-exclusive jurisdiction over disputes relating to these Terms. Nothing in this section prevents you from bringing a claim in another court where you have a non-waivable legal right to do so.
SECTION 23 — HEADINGS
Headings are provided for convenience and do not affect the interpretation of these Terms.
SECTION 24 — CHANGES TO THESE TERMS
We may update these Terms to reflect changes in our Services, business practices, or legal requirements.
The revised Terms will be posted on this page. We will provide additional notice or obtain agreement where required by law.
Changes apply prospectively and do not alter the terms of an order already accepted unless you agree or applicable law requires otherwise.
